PRIVACY POLICY

This Privacy Policy describes the rules for processing personal data of users of the website agabauer.com, including people using the application form for the "Your Insight" process, the list of interested persons, contact forms, payments, coaching services, integration sessions and the "Your Insight" personal development process.

I care about the privacy of people who provide me with their data. I process personal data in accordance with applicable law, in particular the GDPR.

1. Controller of personal data

2. What data I may process

Depending on how you use the Website or my services, I may process the following data:

  • first and last name,
  • email address,
  • telephone number, if you provide it,
  • company details, position or professional context, if you provide them,
  • invoice details, including company name, address, NIP or EU VAT number,
  • data concerning the application, order, payment and performance of the service,
  • date of birth needed to prepare the "Your Insight" Report,
  • context, question or description of the situation provided in the form or by email,
  • the content of email correspondence, forms and messages sent via the Website,
  • organisational information concerning sessions, e.g. meeting date, meeting link, rescheduling status,
  • feedback after the end of the Beta Edition or the process, if you provide it,
  • technical data connected with the use of the Website, e.g. IP address, browser type, cookie identifiers and data on activity on the Website.

I do not need special categories of data, such as information about health, diagnoses, treatment, religion, political opinions, sexuality, origin, philosophical beliefs or other sensitive data. Please do not provide such data in forms or messages unless it is necessary from your perspective.

If, despite this, you provide such information on your own initiative, I will seek to omit, limit or delete it, unless it is needed to handle your matter. If further handling of the matter would require the processing of special category data, I may ask you for additional consent or refuse to further process such information.

Applications for the closed Beta Edition and target personal development processes are collected using the external form system Tally (provider: Tally BV, Belgium). The data provided there is encrypted and processed within the European Economic Area.

Handling the application form for the "Your Insight" process (Pilot Edition). Legal basis: Article 6(1)(b) GDPR (taking steps prior to entering into a contract) and Article 9(2)(a) GDPR (explicit consent of the user) in relation to any special category data voluntarily provided in the form (information about emotions, relationships, wellbeing).

Email or form contact

Data needed to respond and conduct correspondence. Legal basis: the Controller's legitimate interest.

Concluding and performing the contract

Data needed to accept the order, carry out the process, deliver the Report and conduct the Session. Legal basis: performance of the contract or taking steps prior to entering into it.

Preparing the "Your Insight" Report

Name, email, date of birth, optional context, organisational data. Legal basis: performance of the contract. The Report is prepared individually and is not a medical document or diagnosis.

Organising the integration session

Contact details, date, meeting link, organisational notes. Legal basis: performance of the contract.

Handling the Beta Edition and feedback

Contact details and feedback after the process. Legal basis: performance of the contract within the terms of the Beta Edition or the Controller's legitimate interest in developing the service. Publication of testimonials requires separate consent.

List of interested persons and information about the official launch

Email address and, possibly, first name. Legal basis: consent. Consent may be withdrawn at any time.

Newsletter or marketing communication

Email address, first name, information about consents. Legal basis: consent or legitimate interest, depending on the type of communication and applicable law.

Payment handling

Data needed to handle payment. Legal basis: performance of the contract and the legitimate interest in ensuring secure settlements.

Invoices and accounting

Invoice data, transaction data, accounting documentation. Legal basis: a legal obligation imposed on the Controller.

Complaints, withdrawals, claims

Data needed to handle the request and protect rights. Legal basis: the Controller's legitimate interest.

Analytics, cookies and Website security

Technical data, cookies and similar technologies. Legal basis: legitimate interest or consent, depending on the type of files and configuration of the tools.

4. Data needed for the "Your Insight" process

To prepare the Report and conduct the Session, I need the data indicated in the form or agreed individually, in particular your first name, email address, date of birth and the optional context you wish to provide.

I process this data only to the extent necessary to handle the application, conclude and perform the contract, prepare the Report, organise the Session, contact you regarding the process, handle complaints, settlements and secure any potential claims.

The "Your Insight" Report is not a psychological diagnosis, medical documentation or clinical tool. It is developmental and reflective material.

5. Pilot Edition and feedback

In the pilot edition, I may ask you to provide feedback after the process has ended. Feedback is used to improve the quality of the service, the report, the session, communication and the client experience.

The mere request for feedback does not mean consent to its publication. A testimonial, quote, name, initials, company name, image or any information that could identify you may be published only on the basis of your separate, voluntary consent.

6. Recipients of data

Your data may be transferred only to entities that help me operate the Website, provide the service, handle payments, communication, accounting and technical tools. These may include in particular:

  • the hosting and domain provider,
  • the shop or website platform, e.g. Shopify,
  • the forms provider, e.g. Tally BV, Belgium, Shopify Forms,
  • the payment operator, e.g. Stripe Payments Europe, PayU, Przelewy24, PayPal or another operator indicated in the payment process,
  • the email and office tools provider, e.g. Google Workspace or another provider,
  • tools for scheduling meetings and video conferences, e.g. Calendly, Google Meet, Zoom or another tool indicated before the meeting,
  • an accounting office, tax adviser, law firm or other advisers, if needed,
  • the newsletter system provider, 
  • providers of analytical, advertising and cookie tools, if used and if you give the required consents,
  • public authorities, if required by law.

I transfer data only to the extent necessary to achieve a specific purpose.

7. Online payments

Payments may be handled by an external payment operator or by bank transfer. In the case of online payments, the data needed to handle the payment is also processed by the payment operator in accordance with its terms and conditions and privacy policy.

I do not have access to your full payment card details.

8. Invoices and accounting documentation

If you request an invoice or if the law requires one to be issued, I process the data needed to fulfil tax and accounting obligations, in particular your first and last name or company name, address, NIP or EU VAT number, email address and order information.

I store accounting data for the period required by tax and accounting law.

9. Contact form, application form and email contact

If you contact me through a form or by email, I process the data provided in the message in order to respond, conduct correspondence and handle your matter.

I may store correspondence for the time needed to handle the matter, and then for the period allowing me to secure potential claims or demonstrate the course of communication.

10. List of interested persons and newsletter

If you sign up for the list of people interested in the official edition of "Your Insight", I process your email address in order to send information about the launch, availability of places, offer or content directly related to "Your Insight".

If I launch a newsletter, it may contain educational, informational, promotional or marketing content concerning my services, products and content published on the Website.

11. Cookies and similar technologies

The Website may use cookies and similar technologies. Cookies are small files stored on the user's device when using the Website. They may be used, among other things, to ensure the proper functioning of the Website, remember settings, handle forms, ensure security, conduct analytics or carry out marketing activities.

The Website may use:

  • necessary cookies - needed for the proper functioning of the Website, forms, security and remembering privacy settings,
  • analytics cookies - helping to understand how users use the Website,
  • marketing cookies - used to conduct advertising, remarketing or measure campaign effectiveness.

Analytics and marketing cookies are used only where required by law and when you give the relevant consent. You can change your consents in the cookie settings available on the Website or in your browser settings.

12. External tools

External tools may be used on the Website or as part of providing the service, such as:

  • Shopify and Shopify Forms, Tally,
  • Google Workspace, Gmail, Google Meet or Google Analytics, if used,
  • Meta Pixel, Google Ads or other advertising tools, if used,
  • Calendly, Zoom or other tools for scheduling and conducting online meetings,
  • payment operators,
  • a newsletter system,
  • embedded content, e.g. forms, videos or other external elements.

If I use such tools, their providers may process certain technical data or data provided by you in forms.

13. Transfers of data outside the European Economic Area

Some external tools may involve transferring data outside the European Economic Area, e.g. to the United States or Canada.

If such a transfer takes place, it is based on appropriate legal mechanisms provided for by the GDPR, such as an adequacy decision, standard contractual clauses or other permitted safeguards.

This may apply in particular to tools such as Shopify, Google, Meta, Mailchimp, Stripe, PayPal, Calendly, Zoom or other providers used.

14. How long I store data

For the duration of the selection process and, if the person is not admitted to the programme, the data is permanently deleted no later than 30 days after the end of recruitment.

Data related to the provision of the Service

For the duration of the contract, and then for the limitation period for potential claims.

Report, input data and correspondence concerning the process

For the time needed to provide the Service, handle complaints and protect against claims. You may request earlier deletion of the data, provided that this is not prevented by law or a justified need to secure claims.

Accounting data and invoices

For the period required by tax and accounting regulations.

Data from the contact form and email

For the duration of correspondence handling, and then for the period needed to secure potential claims or demonstrate the course of communication.

Data from the list of interested persons or newsletter

Until consent is withdrawn, the subscription is cancelled or the purpose for which the list was created has ended.

Data processed on the basis of consent

Until consent is withdrawn, unless there is another legal basis for further processing.

Cookie data

In accordance with the settings of a given cookie, tool or your consent settings.

15. Your rights

In connection with the processing of personal data, you have the following rights:

  • the right of access to data,
  • the right to rectify data,
  • the right to erase data,
  • the right to restrict processing,
  • the right to data portability,
  • the right to object to data processing, including objection to direct marketing,
  • the right to withdraw consent if the data is processed on the basis of consent,
  • the right to lodge a complaint with the President of the Personal Data Protection Office.

Withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

16. Complaint to the supervisory authority

If you believe that your data is being processed unlawfully, you have the right to lodge a complaint with the supervisory authority.

17. Voluntary provision of data

Providing data is voluntary, but in some cases necessary.

  • lack of an email address will make it impossible to contact you, sign you up for the list of interested persons or send the Report,
  • lack of a date of birth will make it impossible to prepare the "Your Insight" Report,
  • lack of invoice data may make it impossible to issue an invoice,
  • lack of data required to provide the Service may make it impossible to conclude or perform the contract.

18. Profiling and automated decision-making

Your data will not be used to make decisions based solely on automated processing that would produce legal effects concerning you or similarly significantly affect you.

If analytical or advertising tools are used on the Website, they may involve basic marketing profiling, e.g. analysing activity on the Website or matching advertisements. Such activities are carried out only in accordance with applicable law and, where required, on the basis of your consent.

19. Use of AI tools

The "Your Insight" Report is not generated automatically and is not the result of exclusively automated decision-making.

In editorial work, language proofreading, organising the structure of text or preparing supporting materials, I may use tools based on artificial intelligence, such as large language models.

Before entering any content into external AI tools, I apply anonymisation or far-reaching limitation of data. I do not transfer to such tools data that identifies the Client, such as first and last name, email address, telephone number, invoice data or exact date of birth.

If the way I use AI were to change significantly in the future, the Privacy Policy will be updated and, where required, I will ask for appropriate consent.

20. Data security

I apply appropriate organisational and technical measures to protect personal data against access by unauthorised persons, accidental loss, alteration, destruction or unauthorised disclosure.

Access to data is granted only to persons or entities that need it to achieve specific purposes, e.g. handling the application, providing the Service, payments, accounting, technical tools, communication or protection of claims.

21. Links to other websites

The Website may contain links to external services, e.g. payment operators, meeting scheduling tools, social media, external platforms or embedded materials.

I am not responsible for the privacy rules applied by these entities. Before using their services, it is worth reading their terms and conditions and privacy policies.

22. Changes to the Privacy Policy

The Privacy Policy may be updated, in particular in the event of changes to the law, tools used on the Website, the way the Website operates, the scope of services or the scope of data processed.
