TERMS AND CONDITIONS

§ 1. General Provisions

  1. These Terms and Conditions (hereinafter referred to as the "Terms") define the rules and conditions for using developmental services provided electronically via the website agabauer.com, in particular the rules of recruitment, placing orders, making payments, delivering individualized personal development programs in the form of PDF reports, and conducting individual online deep-dive sessions.
  2. The owner of the website and the Organizer of the program (the Seller) is: Agnieszka Bauer, conducting business activity under the name: Agnieszka Bauer, registered address: Warszawa, ul. K. Jędrusik 6/6, Poland, NIP (Tax Identification Number): 1181676290, REGON (National Business Registry Number): 545099835, e-mail address for contact: wglad@agabauer.com.
  3. These Terms are addressed to Consumers, Sole Proprietors with consumer rights, as well as Business Clients (B2B Clients).
  4. Prior to filling out the target form, the Client is obliged to read and accept the content of these Terms and the Privacy Policy.
  5. The "Your Insight" Personal Development Program is strictly individualized and personal. The Organizer does not sell the Service as a gift for third parties. The Client may place an Order exclusively on their own behalf and input into the Form exclusively their own personal data (including their own date of birth and personal context of their life situation).

§ 2. Definitions

  1. Seller / Organizer – Agnieszka Bauer, conducting the business activity described in § 1 section 2.
  2. Client – a natural person, a legal person, or an organizational unit without legal personality but possessing legal capacity, who places an Order within the program.
  3. Consumer – a natural person executing a legal transaction with the Seller that is not directly related to their business or professional activity.
  4. Sole Proprietor with consumer rights – a natural person concluding a contract with the Seller directly related to their business activity, when the content of this contract indicates that it does not possess a professional character for that person.
  5. Program / Service – an individualized personal development and education program, executed in the form of preparing a dedicated PDF Report "Your Insight" and conducting an individual online deep-dive session.
  6. Form – an external electronic form system used to securely collect input data, declarations of intent, and consents from the Client before redirection to checkout.
  7. Payment Gateway – the Shopify Payments system integrated with the Shopify store, supporting online payment authorization (including payment cards and the BLIK system).
  8. Report / Your Insight – an individualized, proprietary educational and reflective material in PDF format, personally developed by the Seller based on the input data provided by the Client.

§ 3. Nature of the Program and Disclaimer

  1. The "Your Insight" Program (including the PDF Report and the deep-dive session) is exclusively of an educational, training, reflective, and coaching nature, supporting the Client's personal development. The methodology is based on a proprietary interpretation of archetypal, symbolic systems and Tarot cards.
  2. The services provided by the Seller do not constitute and do not substitute: business consulting, psychological diagnosis, psychotherapy, psychiatric consultation, medical advice, legal advice, or financial advice.
  3. The Report is not a clinical tool and does not serve to treat any health or psychological ailments. If the Client is in a psychological crisis or experiencing severe distress, they are obliged to immediately seek help from a qualified specialist (a psychologist, psychotherapist, or doctor).
  4. The content contained in the report constitutes an auxiliary tool for the Client's independent work on their own patterns and does not constitute ready-made business recommendations or actionable instructions. The Seller does not guarantee the achievement of specific personal, relational, emotional, or professional results. The final method of utilizing the presented educational content and reflections depends entirely on individual decisions and actions taken independently by the Client and at their own responsibility.

§ 4. Program Characteristics and Pricing

  1. Within the scope of the Organizer's activity, one comprehensive form of developmental service is available: the "Your Insight" Personal Development Program.
  2. The Program inherently consists of the following two elements:
    • Analytical part: personal development and delivery to the Client of an individualized, proprietary report in PDF format of an educational and reflective nature, with an approximate length of 30–35 pages, prepared on the basis of correctly provided input data;
    • Workshop part: one individual, deep-dive coaching and developmental session conducted online in real time, with a total duration of 90 minutes.
  3. The standard price for participation in the full "Your Insight" Personal Development Program is 790 EUR (in words: seven hundred ninety EURO 00/100).
  4. In the case of a dedicated, closed pilot edition, addressed to a limited number of participants for the purpose of optimizing merytorial and technical processes, the special price for participation in the full Program is 399 EUR (in words: three hundred ninety-nine EURO 00/100).
  5. All prices stated in the program are final (gross) prices and are expressed in EURO (EUR). The Seller benefits from a subjective VAT exemption pursuant to Article 113 section 1 of the Polish VAT Act.

§ 5. Technical Requirements, Functionality, and Compatibility of Digital Content

  1. For the correct use of the Program, including filling out the Form, proceeding to checkout, and reading the PDF Report, the following are necessary:
    1. an end-user device (computer, tablet, smartphone) with Internet access and an updated web browser (e.g., Chrome, Safari, Firefox, Edge);
    2. an active and correctly configured electronic mail box (e-mail);
    3. software enabling the opening and reading of files in PDF format (e.g., Adobe Acrobat Reader, system file viewer).
  2. The Seller informs that the "Your Insight" Report constitutes digital content in PDF format.
  3. The Report is compatible with all standard operating systems (Windows, macOS, iOS, Android) that support the PDF format. The Seller does not provide updates to the PDF Report after its delivery, unless the delivered file possessed technical defects.

§ 6. Order Placement Procedure and Moment of Conclusion of the Contract

  1. The sale of the "Your Insight" Personal Development Program (including the PDF report and the deep-dive session) takes place in a one-stage direct order model using the integrated systems of Tally (the Form) and Shopify.
  2. In order to place an order and join the Program, the Client is obliged to perform the following actions on the website agabauer.com:
    1. correctly fill out the substantive fields in the Form, including providing identification data and input data necessary to prepare the report (name, e-mail address, exact date of birth, and an optional description of the context of their personal situation);
    2. read the content of these Terms and the Privacy Policy, and mark the mandatory checkboxes containing declarations of acceptance of these documents, explicit consent to the processing of sensitive data, and consent to the delivery of digital content before the expiry of the right of withdrawal period;
    3. click the data confirmation button, which automatically generates a secure cart link (Cart Permalink) and redirects the Client directly to the Checkout of the Shopify system.
  3. At the Shopify Checkout stage, the Client selects a payment method and finalizes the transaction via the Shopify Payments system. The finalization button in the Shopify checkout clearly indicates the obligation to pay.
  4. The contract for the provision of an individualized personal development service electronically is legally and formally concluded at the moment of successful payment by the Client (the crediting of funds or receiving a positive authorization status from the Shopify Payments system).
  5. After the conclusion of the contract, the system automatically generates and sends an order summary to the Client's e-mail address, which simultaneously constitutes confirmation of the conclusion of the contract and the recording of consumer declarations on a durable medium.
  6. In the case of filling out the Form but failing to complete the payment transaction in the Shopify system (abandoned cart), the contract does not come into effect, and the input data provided by the user in the Form are deleted from the Administrator's database without undue delay, no later than within 48 hours from the moment of abandoning the form, for security purposes and compliance with GDPR.
  7. Inputting personal data, input data, or descriptions of life situations belonging to third parties into the Form without their explicit consent is strictly prohibited and constitutes a flagrant violation of these Terms and data protection regulations (GDPR). In the event of a reasonable suspicion that the data belongs to a third party, the Seller reserves the right to immediately withdraw from the contract due to the Client's fault, cancel the order, and permanently delete the data from the database.

§ 7. Payments and Invoicing

  1. Payment for participation in the program is made online via the integrated Shopify Payments system (supporting payment cards and the BLIK system).
  2. The Seller issues invoices documenting the sale. The invoice is issued with the item description: „Participation in the individualized personal development program "Your Insight" and a note regarding the VAT exemption pursuant to Article 113 section 1 of the Polish VAT Act. The invoice is sent to the Client automatically via electronic means.

§ 8. Time and Method of Program Execution (PDF Report)

  1. The standard deadline for the preparation and delivery of the PDF Report is from 7 to 12 business days.
  2. The running of the execution period begins on the day following the day on which two conditions are met jointly: the full payment is credited in the Shopify Payments system and the Seller receives the complete input data via the Form.
  3. The Report is delivered in the form of a PDF file via electronic mail to the e-mail address specified by the Client during registration.
  4. The Report is prepared based on the input data (in particular the date of birth) provided by the Client. The Client is obliged to carefully check its correctness. In the event of providing an incorrect date of birth and discovering this fact after the finished report has been sent, the service is deemed to have been performed correctly. The preparation of a new report for corrected data requires placing a new, fully paid order.

§ 9. Rules for Conducting Individual Deep-Dive Sessions

  1. The individual, deep-dive coaching and developmental session lasting 90 minutes constitutes an integral element of the "Your Insight" Personal Development Program.
  2. In order to maintain continuity and maximize the effectiveness of the training and developmental process, the Client is obliged to book and attend the session within 60 calendar days from the day the individualized PDF Report is delivered to their e-mail address.
  3. Booking the session date is done by the Client independently using the integrated Calendly system, the link to which is provided to the Client in the e-mail message along with the finished PDF Report. In the event of a lack of availability of convenient dates in the Calendly system or a system failure, the Client is obliged to immediately contact the Seller via e-mail (wglad@agabauer.com) in order to manually establish the session date.
  4. If a Client, who is a Consumer or a Sole Proprietor with consumer rights, does not book the session within the 60-day period referred to in section 2, the Seller shall request the Client via e-mail to schedule a session within an additional 14 days. The ineffective expiry of this additional period due solely to the Client's fault, shall mean that the Seller remained fully ready to provide the service, and that the failure to carry out the session resulted from reasons attributable to the Client, namely the creditor's failure to cooperate pursuant to Article 639 of the Civil Code. In such case, the Seller shall be entitled to full remuneration , and the obligation shall be deemed fulfilled. 
  5. The Client has the right to a one-time change of the booked session date, provided that they inform the Seller via e-mail or through the Calendly system no later than 24 hours before the scheduled start of the meeting.
  6. In the event of the Client's absence from the online session (a delay exceeding 15 minutes) or an attempt to reschedule it less than 24 hours before the agreed time, the session date shall be forfeited and the Seller shall retain the right to remuneration on account of documented damage related to reserving working time and being unable to serve another Client during that time slot.
  7. The session is conducted online in real time using a communicator indicated by the Seller (e.g., Google Meet / Zoom). The session is not recorded by the Seller, and the Client is prohibited from recording it (audio/video) without the prior, explicit consent of the Seller under penalty of immediate termination of the session due to the Client's fault.

§ 10. Right of Withdrawal from the Contract (Exclusion of Returns)

  1. A Consumer and a Sole Proprietor with consumer rights are, in principle, entitled to a right to withdraw from a distance contract within 14 days without giving any reason.
  2. Pursuant to Article 38 section 1 point 3 and point 13 of the Polish Act on Consumer Rights, the right of withdrawal from a distance contract is not available to the consumer in respect of contracts:
    • for the supply of digital content not delivered on a tangible medium, if the performance has begun with the consumer's explicit consent before the expiry of the withdrawal period and after the trader has informed the consumer of the loss of the right of withdrawal (point 13);
    • in which the subject of the performance is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individualized needs (point 3).
  3. By marking the appropriate checkbox in the Form before making the payment, the Client submits an explicit declaration requesting the commencement of the performance of the service and the delivery of the digital report before the expiry of the 14-day period, and acknowledges that upon delivery of the finished PDF report to their e-mail address, they lose the right to withdraw from the contract in the part concerning that report, under the terms described in detail in section 4 of this paragraph
  4. Due to the hybryd nature, comprising both a PDF Report and an online deep-dive session (package), the right to withdraw from the contract after the PDF Report has been delivered is excluded only in relation to that Report, as digital content. The Client retains the right to withdraw from the contract in the part concerning the online Session within 14 days from the date of purchase, provided that the Session has not yet been fully performed. For the purpose of settlements related to partial withdrawal from the contract, the parties agree that the value of the PDF Report constitutes 70% of the package price, and the value of the online Session constitutes 30% of the package price.

§ 11. Complaints and Conformity of Digital Content with the Contract

  1. The Seller bears liability for the conformity of the digital content and services with the contract under the rules set out in Chapter 5b of the Polish Act on Consumer Rights.
  2. Complaints regarding the functioning of the program, corruption of the PDF file, or non-conformity of the delivered material with the product specification description, or improper performance or non-performance of the online Session, should be submitted via e-mail to: wglad@agabauer.com.
  3. A correctly submitted complaint should contain: name, surname, the e-mail address used in the order, and a detailed description of the technical defect or non-conformity.
  4. The Client's subjective feelings, lack of identification with the merytorial archetypal interpretation, or lack of satisfaction with the reflective conclusions do not constitute grounds for a complaint, provided that the report was executed in accordance with the specification, the methodology described on the website, and the input data provided by the Client.
  5. The Seller reviews complaints within 14 days from the day of their receipt. The response is sent to the Client's e-mail address.

§ 12. Protection of Copyrights and Confidentiality (NDA)

  1. The "Your Insight" Report and the structure of the merytorial forms constitute works within the meaning of the Polish Act on Copyright and Related Rights and are subject to full legal protection.
  2. The Client receives the product exclusively for their own, private educational and developmental use. Without the prior written consent of the Seller, it is prohibited to copy, resell, sub-license, publish on the Internet (in whole or in part), or utilize the methodology or content of the report as one's own training or advisory material in the Client's commercial activity.

§ 13. Final Provisions

  1. In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular the Civil Code and the Act on Consumer Rights.
  2. The Consumer has the opportunity to use out-of-court methods for reviewing complaints and pursuing claims, including via the ODR platform (http://ec.europa.eu/consumers/odr).
  3. These Terms come into force on June 22, 2026.
